I’m writing a story and I need it to be as realistic as possible. It’s about a girl who gets molested as a child and keeps it a secret for six years. She finally decides to tell. The thing is, she’s telling her doctor first because she trusts him a great deal. She wants him to help her tell her mom. I think that I’m going to have the man be dead, and the girl finds out at the doctor’s office. I guess that’s it. And I suppose this is relevant, one of my friends told me there’s a law saying something like the cops can’t do anything after five years. So yeah. I REALLY need this. It’s important. When a report can be acted on by law enforcement has more to do with the state laws.
In general a molestation is a felony. In my state the statute of limitation on prosecution for a felony is 5 years BUT in sex cases it also depends on the age of the victim at the time of molestation. If a minor the clock does not start running until the victim reaches 17 then there is a two year period to start the court system after the offender. My state also has a provision for recovered memories.
If the guy were alive the doctor must contact authorities. It depends on the age and relationship of the victim and offender on who he contacts.
In general if the victim is a kid and the offender is a relative or person who lives in the same household as the victim the doctor contacts the family or child protective services. In reality in most heavily populated areas family services then contacts the police who go out to the scene to take immediate action.
If the offender is dead the doc does not have to report unless actions by those still in the household or who have access to the victim, abetted the offender.
Is your question what the statute of limitations is for rape? OR would a doctor call the cops if he found a dead body?
